By accessing or using adverts.gg ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Platform. These Terms apply to all visitors, buyers, sellers, and other users.
adverts.gg is a marketplace that connects advertisers ("Buyers") with Discord server owners ("Sellers") for the purpose of purchasing @everyone or @here ping advertisements in Discord communities. The Platform facilitates transactions but is not a party to the underlying advertising agreement between Buyers and Sellers.
You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Platform. By using the Platform, you represent and warrant that you meet these requirements. You must authenticate via Discord OAuth and comply with Discord's Terms of Service at all times.
Sellers must: (a) own or have administrative control of the Discord server they list; (b) accurately represent server membership counts and engagement; (c) deliver the purchased @everyone ping within the agreed timeframe; (d) comply with Discord's Community Guidelines and Terms of Service; (e) not list servers that promote illegal activity, hate speech, adult content, scams, or any content that violates Discord's policies.
Sellers who fail to deliver orders may have their accounts suspended and funds withheld pending dispute resolution.
Buyers must: (a) provide ad content that complies with Discord's Terms of Service and all applicable laws; (b) not submit ad content that is illegal, deceptive, fraudulent, or violates any third-party rights; (c) not attempt to circumvent the Platform's payment system or contact Sellers directly to avoid fees.
The Platform charges a 20% platform fee on all transactions. Buyers pay the listed price plus applicable fees at checkout. Sellers receive 80% of the transaction value, paid out via Stripe Connect after a 7-day hold period following order completion. All prices are in USD. Payments are processed securely by Stripe.
The Platform reserves the right to modify its fee structure with 30 days' notice to active users.
All sales are final once an order is marked as delivered. Buyers may open a dispute within 7 days of delivery if: (a) the ad was not delivered as agreed; (b) the delivered content materially differed from what was purchased. The Platform will review dispute evidence including ad content, delivery screenshots, and Stripe payment records. The Platform's decision on disputes is final.
Chargebacks initiated outside of the Platform's dispute process may result in account suspension.
The following content is strictly prohibited on the Platform: illegal goods or services; adult or NSFW content; gambling or betting services (unless legally licensed); malware, phishing, or scam content; content that infringes intellectual property rights; hate speech, harassment, or discriminatory content; anything that violates Discord's Terms of Service.
The Platform reserves the right to suspend or terminate any account at its sole discretion for violations of these Terms, fraudulent activity, chargebacks, or any conduct deemed harmful to the Platform or its users. Terminated sellers forfeit any pending payouts if termination is due to policy violations.
Buyers retain ownership of their ad content. Sellers retain ownership of their Discord server branding. By listing on the Platform, Sellers grant adverts.gg a non-exclusive license to display their server information, icon, and description for promotional purposes.
The Platform is provided "as is" without warranties of any kind. adverts.gg shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of revenue, loss of data, or business interruption. Our total liability shall not exceed the fees paid by you in the 3 months preceding the claim.
You agree to indemnify and hold harmless adverts.gg and its operators from any claims, damages, or expenses (including legal fees) arising from your use of the Platform, your ad content, or your violation of these Terms.
These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the new Terms. Material changes will be communicated via email or Platform notification.
